19 year old Carlos Ariel Martinez-Gutierrez was arrested by Eureka Police Department yesterday for PC 148 (a) (1) resisting arrest, HS 11378 possession of meth with intent to sell and HS 11351 possession for sale of a controlled substance.

One CBE lawsuit dismissed, 3 CBE lawsuits nothing happening but civil appeal filed in Eureka Housing for All lawsuit against City of Eureka

Out of four lawsuits filed by Citizens for a Better Eureka, one was dismissed after the Wiyot Tribe's motion was granted by Judge John Feeney. Nothing has happened in the other 3 cases for months since CBE withdrew request for the preliminary injunction. In the fifth lawsuit filed by Eureka Housing for All vs City of Eureka, the demurrer filed by City of Eureka was sustained without leave to amend by Judge Timothy Canning, the Humboldt Superior Court case was closed. On 3/20/24 civil appeal was filed. Documents from the California First District Court of Appeal are listed below.

Security National never responded to my request about the status of the housing project on Indianola. It has been 13 days. EHA never bothered to inform media an appeal had been filed. 

Verdict in alleged molestation, upskirting case is hung jury on 2 counts, Count 2 not guilty and guilty only on peeping tom charge

 


Today is day 10 of the Nick Martinez jury trial. This time includes jury selection, evidence and deliberations. This is a 2020 case. Ms. Andrea Sullivan was court appointed to this case in January 2024 after Conflict Counsel declared a conflict.

Jurors informed judge around 11:40 about status of deliberations. Verdict to be read at 1:30. Based on the readback requested, I have a feeling about the verdict. I will be in the courtroom this afternoon.

After lunch, before the jury was brought back, Judge Steven Steward told Ms. Andrea Sullivan, Nick Martinez, Deputy District Attorney Whitney Timm and DA Investigator Ryan Hill that jurors asked for readback of Jane Doe's testimony in the shed. Count 1 is the alleged incident in the shed. That note is Exhibit #5. The jurors had also requested readback of Jane Doe's testimony yesterday along with witness Elena Lopez and DA Investigator Hill's testimony.

Judge Steward said he got a second note, Exhibit 6  at 11:40 and jurors informed him they were unable to come to an unanimous decision on two of the four charges. 

Read what I wrote on 4/14. This was before I knew what readback was requested or the status of where jurors were today. 

Ms. Sullivan won a key motion about Jane Doe before evidence was presented. One of the possibilities I mentioned was a mixed verdict. I was correct. The People made offers before trial to resolve which was an indication that the DA's office knew what could happen with a jury. Yet they chose to amend charges and put Jane Doe through a trial. Sentencing and trial setting is scheduled for 4/23. Is the DA going to waste more resources and retry this case. I can cite Ray Christie and Deirdre Peterson which are only two examples of failed attempts by the DA's office spanning over two decades. 

There are several molestation and child porn cases more recent that need to have a preliminary hearing or go to trial. The DA's office needs to focus on those cases.

Suspect on the lam in Trinidad burglary arrested by HCSO on Ramey warrant

 


51 year old Theodore Earl Nelson was arrested yesterday by HCSO on a Ramey warrant. He was booked for PC 148(a)(1) resisting arrest, PC 182(a)(1) criminal conspiracy, PC 459/461(a) burglary, PC 594(b)(1) vandalism, VC 14601.1(a) driving on a suspended license, VC 14601.2(a) driving with a license supended for a DUI and FG 2000 illegal hunting, killing, or capturing of wild or game animals.

The charges match this suspect on the lam from a burglary in Trinidad.

Michael Black wanted to represent himself, bail of $90,000 changed to no bail after Black threatens Deputy DA in court

 


Until 2023, Michael Black had a Trinidad adress in court records. For his 2024 case there is a P.O. Box in Willow Creek. Black has a 2023 DUI conviction in addition to his 2019 conviction in the case involving his former lawyer and neighbor Russ Clanton.

On 4/12, the DA filed a complaint and a first amended complaint on the same day. His arraignment was continued by the court to this afternoon with an OR/bail hearing. Black was provided with a Faretta waiver form because he wants to represent himself. Bail is currently $90,000. There are two alleged victims for the two criminal threats charges and both charges allege the use of a hatchet. Black is charged with illegal possession of a Rogue Rifle Company Chipmunk. Fifth count alleged victim Deputy Wolff.

4/15 update: Black is not representing himself. Ms. Andrea Sullivan wa retained and was in court for the arraignment. Black was denied supervised release by Judge Lawrence Killoran. Then he started making comments at Deputy District Attorney Alex Grotewohl which Judge Killoran took as threats. Judge Killoran revoked his bond and now Black is on no bail status without prejudice. Black's custody status and criminal protective order can be addressed at preliminary hearing which is scheduled for 4/25.

Gerald McGuire does not want Michael Acosta as his lawyer anymore

 


The 4/5/24 writ of mandate hearing in Gerald McGuire v. County of Humboldt was continued to 4/19. McGuire told Judge Timothy Canning he had not spoken with his attorney, Michael Acosta, "for some time."

When I checked e court today, it says the hearing says set in error but also lists the same date as an administrative hearing. 

Former Humboldt Court reporter who worked for almost 40 years is suing the County of Humboldt

 


I saw a hearing on the 4/8 calendar for a 2023 case;  Kay Marie Gibbs vs County of Humboldt. I recognized the name because Kay was one of the best Humboldt Superior Court reporters. She worked for the local courts for almost 40 years.

Del Norte Superior Judge Darren McElfresh has been assigned to the case. Mr. Patrik Griego is representing Kay. The lawsuit has four allegations of failure to discharge mandatory duty under government code and one allegation of negligence. After the April 12 hearing, Judge McElfresh will issue a written ruling.

Stalking and criminal threats suspect Analia Martinez had two cases on calendar on 4/12. In one case, she is represented by the Public Defender and in another case by Ms. Kathleen Bryson. Her case with the PD was on for arraignment on information and the other case for pre trial.

Defense wins key motion about Jane Doe in alleged molestation and upskirting case, jury requests readback

 


Both the defense and People had some wins with motions in limine last week in alleged molestor and upskirter Nick Martinez jury trial. Jury selection was completed, evidence was presented and jury deliberations started on 4/12.

Jury deliberated for 2.5 hrs on Friday. They requested readback of DA Investigator Ryan Hill, witness Elena Lopez and Jane Doe. That readback was done on 4/15. Jury still deliberating on 4/16.

Convicted upskirter, sex offender and former Humboldt court mediator in jail again, scheduled release in June

 



After the last hearing, convicted upskirter, sex offender and former Humboldt court mediator Joe Hale was out of options. Mendocino Judge Ann Moorman made it very clear no excuses and no more continuances.

Hale was booked today into the jail today and his scheduled release is June 22, 2024 unless Hale and his public defender try some stunt to get him released earlier again. I was the only one to cover the three hearings on the DA's motion to recommit Hale to jail and have him finish his jail sentence.

10 year registration as a sex offender, 5 years in prison for Brandon Shorey

 


On 4/9, Brandon Shorey was sentenced to 5 years in prison for domestic violence, sexual battery and using a deadly or dangerous weapon in the commission of a felony. Shorey has to register as a sex offender for 10 years.

By resolving his case before trial, Shorey got less time in prison and conviction for a lesser charge instead of forcible rape and forcible oral copulation.

Some anons are spinning different tales online. If any of the keyboard warriors have evidence of their claims, provide it to the community with your real name. Just throwing out information without proof anonymously so you can avoid consequences is typical Humboldt. There are a lot more pressing issues facing Eureka and other news to cover. Time will reveal the impact of dissolving the Foundation and whether the City of Eureka can continue the fundraising, membership and events.
